Michael K. Botts

Michael K. Botts has engaged in the practice of law for over 30 years, focusing on intellectual property since 1986. Since 2002, his practice has largely centered on computer design and systems, electronics, and software technologies. Mr. Botts has extensive litigation experience with nearly 40 first chair trials in state and federal courts across the country. He has served as lead trial counsel in cases involving all areas of intellectual property rights, including patent infringement, trademarks, trade secrets, and copyrights.

Mr. Botts has represented individuals and corporations in industries involving electronics and computers, medical research, publishing, and consumer products. He has also taken the lead in litigations and trials involving defamation and publication issues (business and personal libel, slander, privacy, and First Amendment), medical actions (Federal Employers Liability Act (FELA), medical research, medical malpractice, consumer protection), contracts (IP licensing, insurance law, breach of contract, consumer and business fraud, RICO, Federal Tort Claims Act (Qui Tam), and construction litigation), and tort law.

Prior to becoming affiliated with O’Kelly Ernst & Joyce, LLC as Of Counsel, Mr. Botts worked for the United States Patent and Trademark Office and large patent prosecution and litigation firms before starting his own practice. He attended Iowa State University, earning four degrees: B.A. Music, B.S. History, B.S.E.E. Electrical Engineering, and B.S.Cpr.E. Computer Engineering. Mr. Botts earned his law degree from Drake University Law School where he was a member of the Drake Law Review.

Mr. Botts is admitted to practice law in the District of Columbia, and in the Supreme Court of the United States America. Mr. Botts is admitted to and has argued cases before many Federal Courts of Appeal, including the Federal Circuit Court of Appeals, as well as appearing as lead counsel in legal actions and trials in United States District Courts nationwide. Mr. Botts is a member of the American Intellectual Property Law Association (AIPLA), and he is also a member of the Institute of Electrical and Electronics Engineers, Inc. (IEEE) and the IEEE Computer Society.
